Terms of Use

These Terms of Use ("Terms") govern your access to and use of AdForge (app.adforge.app), operated by Hubbvee ("we", "us", or "our"). By accessing or using AdForge, you agree to be bound by these Terms.

1. Accounts

To use AdForge, you must create an account using Google Sign-In. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

2. Acceptable Use

You agree to use AdForge only for lawful purposes and in accordance with these Terms. You agree not to:

• Use AdForge in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the platform, other accounts, or connected systems.
• Use AdForge to send spam, misleading advertisements, or content that violates Meta or Shopify advertising policies.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Use automated scripts or bots to access AdForge, except through our provided APIs.
• Interfere with or disrupt the platform or its infrastructure.

3. Connected Platforms

AdForge connects to third-party platforms including Meta (Facebook) and Shopify. Your use of these integrations is subject to the respective platform's terms of service. We are not responsible for changes, outages, or policy updates from these third-party platforms.

You are responsible for ensuring that your advertising activities comply with Meta's Advertising Policies and Shopify's Acceptable Use Policy.

4. Intellectual Property

The AdForge platform, including its design, code, features, and documentation, is the intellectual property of Hubbvee. You may not copy, modify, distribute, or create derivative works based on AdForge without our express written permission.

You retain all rights to the data and content you provide through the platform, including your advertising creatives and campaign data.

5. AI-Generated Content

AdForge provides AI-powered features for creative generation and analysis. Content generated by AI tools is provided as suggestions only. You are solely responsible for reviewing, approving, and using any AI-generated content in your advertising campaigns. We make no warranties regarding the accuracy, suitability, or compliance of AI-generated content.

6. Service Availability

We strive to provide reliable access to AdForge, but we do not guarantee uninterrupted or error-free service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

7. Data and Privacy

Your use of AdForge is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Hubbvee and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data.
• Advertising spend resulting from guardrail misconfigurations or system delays.
• Losses arising from reliance on AI-generated recommendations or forecasts.
• Interruptions to your advertising campaigns due to service outages or third-party platform changes.

Our total liability for any claim arising from your use of AdForge shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Hubbvee from any claims, damages, losses, or expenses (including legal fees) arising from your use of AdForge, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to AdForge at any time, with or without cause, with or without notice. You may stop using AdForge at any time. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will survive.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of AdForge after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada.
